[discuss-dan] Illegal Police Actions



Kerry Appel gave me permission to forward this. As background, after the
"Santa Claus" action at Kohl's, Golden and Denver police got a search
warrant for the DJPC and, apparently, AFSC offices, and confiscated, among
other things, membership lists for DJPC and Chiapas Coalition. I have been
told that Golden police have also called at least some of the names on the
DJPC membership list.

Dear Chiapas Coalition members and others on this list.

Today, at approximately 2:10 pm two City of Golden police detectives in
civilian clothing approached the door of the Human Bean Company.  Two
friends, one of them being Sue Tyburski, who is one of our illustrious
attorneys, and I were on our way out the door to go have lunch.  Upon
opening the door to leave we spotted the two suspicious looking men.
One of them, a slight, dour faced man, asked if I was Kerry Appel.

"I am." I said.  I immediately was sure, because of the demeanor of the
men, that one of them was going to slap a subpeona in my hand or
something like that.

"Do you mind if we talk to you?" He asked.

"Who are you?"

"We're detectives with the Golden police department and we'd just like
to ask you some questions. Would you mind answering some questions?"

"Yes, I would.  I have nothing to say to you but I was expecting you to
come here at some time.  I understand that you illegally confiscated
some records of the Chiapas Coalition.  You showed up at the Denver
Justice and Peace Committee with a search warrant for their records and
you specifically asked for and confiscated a phone list of some of the
Chiapas Coalition records.  The Chiapas Coalition phone list wasn't on
your search warrant was it?"

"That was some other people who did that." he stammered, "Do you mind
talking with us?"

"I don't have anything to say to you.  If you want to talk to me come
back with a warrant and charge me with something and I'll talk to you in
the presence of a lawyer.  By the way, this is one of our lawyers, Sue
Tyburski."

At this point Sue broke in and began to ask the detectives what they
were doing and what this was all about.  The detectives said that they
were investigating the "criminal mischief" and property destruction at
Kohl's Department Store in Golden.  They said that four people destroyed
property worth $50,000 during a protest there late last year.

The detective that was doing all of the talking then told Sue that they
merely wanted to ask some people what they knew about this and that
since Kerry Appel (myself that is), the object of their interest at the
moment, had expressed his unwillingness to talk that they would be
going.

"Take care."  The detective said to me as he left.

"Yeah, and you take care that you respect people's rights." I answered.

The detectives name is J.D. Kreutzer.  He works for the City of Golden
Police department.  His phone number is (303) 384-8063.  His email is
<jkreutzer@ci.golden.co.us>.  His superior's name at the Golden Police
Department is Bill Kilpatrik and his phone number is (303) 384-8045.

I called Bill Kilpatrik and asked him how I was associated in any way in
the Kohl's investigation.  He said that they had executed a search
warrant at the DJPC and had confiscated records that must have included
my name.  I informed him that I was aware of their search warrant and
their raid on the DJPC office but I was also aware that they had
confiscated records that were not on their search warrant, namely some
records of the Chiapas Coalition.

I told him that I considered their confiscation of any records relating
to the Chiapas Coalition to be invalid and a violation of our rights to
privacy and that, as a co-founder of the Chiapas Coalition, I wanted
them to stop any contact, questioning or any other type of harrassment
of Chiapas Coalition members.  I also told him that, although no one has
made any such decision as of yet, if they did continue to contact
members of the Chiapas Coalition, that we would look into the
possibility of a suit against the Golden Police Department.

He informed me that he thought they had every right to seize Chiapas
Coalition records and that they would continue their investigiation as
they saw fit.  One of the justifications that he made for this is that
no one had any obligation to anwser any questions so it wasn't
harrassment.

I called my attorney, Walter Gerash, and left a message for him
informing him of what had happened.

So my advice to anyone who is contacted is:

DON'T LET THEM INTO YOUR BUSINESS OR YOUR HOME!

DON'T ANSWER ANY QUESTIONS!

DO NOT FEED THEM (NO DOUGHNUTS)!

COMPLAIN ABOUT THEIR ILLEGAL SEIZURE OF YOUR NAME, PHONE NUMBER, ETC!

TELL THEM TO AWAY!

TELL THEM NOT TO SHOP AT KOHL'S BECAUSE KOHL'S PRODUCTS ARE PRODUCED BY
EXPOITATION AND HUMAN RIGHTS VIOLATIONS!

Actually, be careful about engaging them in any extraneous conversation
because they are trained in getting you to say more than you have any
need to say.
